Judge Miroslava Todorova wins case against Bulgaria at the European Court of Human Rights

Judge Miroslava Todorova won her lawsuit against Bulgaria at the European Court of Human Rights in Strasbourg. The former Chairperson of the Bulgarian Judges Association referred the matter to the European Court of Human Rights in 2013.

Relying on Article 6 § 1 (right to a fair trial) of the European Convention, the applicant complains about various aspects of the fairness of the disciplinary proceedings against her. Under Article 8 (right to respect for private life), Miroslava Todorova maintains that the disciplinary sanctions and the publicity given to the disciplinary proceedings infringed her right to respect for her private life and her reputation.

The court found a causal link between the penalties imposed on her and her critical stance towards the Supreme Judicial Council and Tsvetan Tsvetanov, who served as Minister of Interior at the Borissov 1 cabinet. The court also found that the freedom of expression of magistrate Todorova was restricted.
