Bulgarian President refers extraordinary epidemic measures to Constitutional Court

President Rumen Radev has referred the provisions of the Health Act and the declaration of an emergency epidemic situation to the Constitutional Court. The head of state disputes the power of the Council of Ministers to declare the measures, as well as the lack of a deadline for the duration of the measure and the criteria for assessing the danger to human life and health, and the disproportionate restriction of their rights.


According to the President, the changes to the Health Act move the law away from constitutional standards, which allow restriction of fundamental rights. The role of the legislature in this process is also ignored, the President Radev adds.
