Bulgaria’s Constitutional Court annuls amendments to Obligations and Contracts Act

Bulgaria’s Constitutional Court has annulled the amendment to the Obligations and Contracts Act (article 112), by which the previous National Assembly enforced a ten-year limitation period for obligations of natural persons. 10 magistrates voted in favor and 2 voted against. 

The amendment had to come into force on June 2, 2021 and apply to existing cases. This county’s Supreme Judicial Council challenged the decision of the Parliament. According to the Supreme Judicial Council, "the new limitation period contradicts the inviolability of private property guaranteed by the constitution, as well as the rule of law", wrote egalworld.bg referring to the decision of the Constitutional Court.
